Terms & Conditions

These Terms and Conditions (Conditions) set out the basis on which Casa do Alto (as defined below) will provide accommodation and other products and services at its accommodation to Customers (as defined below) and Guests (as defined below). By making a Booking (as defined below) the Customer agrees to comply with these Conditions.

  1. INTERPRETATION

In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

“Arrival Date” means the date on which the Customer’s stay at the accommodation is due to commence, as per the Booking Details
“Booking” means the reservation by the Customer of accommodation and any other products and services detailed in the Booking which is accepted by Casa do Alto
“Booking Details” means the details of the Booking including the number of Guests, the number of rooms required, the duration of the Guests’ stay at the accommodation and any other products and/or services to be included in the Booking
“Charges” means the charges payable by the Customer in connection with the Booking
“Contract” means the contract between the Customer and Casa do Alto in relation to the Booking
“Customer” means person who makes the Booking
“Casa do Alto” means Passos e Terlingen Unipessoal Lda (registered company in Loulé with the number PT513899537)
“Guests” means the Customer and any third parties they invite to the accommodation in connection with the Booking
“Accommodation” means the Alojemento Local (Local accommodation) with license number  27019/AL owned or operated by Casa do Alto the location of which is specified in the Booking

  1. BOOKINGS

2.1 Customers can request Bookings via Casa do Alto’s website or by contacting Casa do Altos staff at the accommodation by phone or email.
2.2 When requesting Bookings, Customers will be required to provide identification information including, but not limited to, their name, contact telephone number and email address.
2.3 No request for a Booking should be deemed to be accepted unless and until Casa do Alto confirms its acceptance and provides a booking reference, at which point the Contract will come into existence.
2.4 Subject to clause 4 Casa do Alto will use its reasonable endeavours to accommodate any request from the Customer to change the Booking Details but any request to change the dates or length of stay or add products and/or services will be subject to availability and the Customer paying for such increased length of stay and/or products and/or services at Casa do Alto’s standard rates from time to time.

  1. FEES AND PAYMENT

3.1 The Charges will be as quoted by Casa do Alto to the Customer upon the Customer’s request for a Booking.
3.2 Unless otherwise agreed by Casa do Alto, the Charges only cover the provision of accommodation at the accommodation and the Customer may incur additional charges including, without limitation, charges for meals, drinks, pets, and other services (the “Additional Charges”).
3.3 Customers will be informed of the amount of the Additional Charges before they are incurred.
3.4 Bookings will be subject to the Customer:
making payment of the Charges in full in advance or, at Casa do Alto’s option, paying a booking fee and/or deposit; or providing valid Debit or Credit Card details via which payment of the Charges or the balance of the Charges(as the case may be) and any Additional Charges can be taken at check in at the accommodation or at the time of booking.
3.5 If not prepaid in full at time of booking the balance of the Charges must be paid by the Customer immediately on checking in at the accommodation. Any Additional Charges must be paid either as they are incurred or, at Casa do Alto’s option, upon the Customer checking out at the accommodation.
3.6 The following payment methods are accepted by Casa do Alto
3.6.1 Credit and Debit Cards
Visa, Mastercard, Maestro and V-Pay
3.6.2 Online transactions
Bank transfer, PayPal and MB-way
3.6.3 Cash or Credit or Debit Cards, if the Customer is paying in person at the accommodation.

  1. CANCELLATIONS

4.1 Subject to clause 4.2, the Customer may cancel the Booking without charge if notice is given to Casa do Alto at least 168 hours (7 days) prior to 15:00 hours (local time) on the Arrival Date. In which case Casa do Alto will refund to the Customer all sums paid by the Customer in advance.
4.2 Where the Customer has been offered a discounted rate on condition that the Booking becomes non-refundable upon cancellation then, provided the Customer has been informed of such Condition, in the event of cancellation of the Booking, all Charges applicable to that Booking remain payable in full.
4.3 Where the Customer fails to give sufficient notice of cancellation as per clause 4.1 the Customer must pay the accommodation 50% of the full amount equivalent to the Charges applicable of the stay at the accommodation.
4.4 Where the Customer fails to arrive before 21.00 on the Arrival Date (no show) or give sufficient notice of Late Arrival at the accommodation, the Booking will be deemed cancelled and the Customer must pay the accommodation an amount equivalent to the Charges applicable to the full amount of the stay at the accommodation.
4.4 Casa do Alto may at any time cancel a Booking if the accommodation becomes unavailable due to circumstances outside Casa do Alto’s control in which case Casa do Alto twill pay the Customer a full refund of any Charges and any booking fee paid.
4.5 Casa do Alto may at any time cancel the Booking if the payment details provided by the Customer in accordance with clause 3.4.2 are invalid and the Customer fails to provide alternative valid details.

  1. CHECK IN AND CHECK OUT

5.1 Check-in time during summer months at the accommodation booked is from 15:00 hrs until 21:00 hrs. Check-in prior to 15:00 hrs. may be available subject to prior arrangement with Casa do Alto and subject to the full range of services and facilities at the accommodation not being available until the standard check in time.
5.2 Check-in after 21:00 hrs, Late Arrival, is only available subject to prior arrangements with Casa do Alto in the form of self-check in. The customer must comply by providing valid photo identification in accordance with clause 6.1 and the Booking must be paid in full minimum 24 hours prior to 15:00 hours (local time) on the Arrival Date.
5.3 Check-out time at the accommodation booked is 12:00 hrs. Later check-out times may be possible by prior arrangement but is subject to availability. (In the absence of such prior arrangement,) failure to check-out by 12:00 hrs may result in the Customer  being charged for an additional night’s accommodation at the standard applicable rate.
5.4 Luggage storage is provided for free until 21:00 of the same day of checking out and can be arranged with reception.

  1. ACCOMMODATION RULES

6.1 Valid photo identification in the form of a Identification Card, Passport, Residence permit (EU only) or Portuguese Driver’s license is required at check-in. For non-residents of Portugal, both Customer and all guests must show valid photo identification.
6.2 Customers are required to conduct themselves and ensure that their Guests conduct themselves in a reasonable and responsible manner at the accommodation and must not act in any way which may disturb other guests. Failure to adhere to this requirement may result in Guests being asked to leave the accommodation in which event all Charges and Additional Charges shall become immediately payable by the Guest.
6.3 Smoking is not permitted inside the accommodation l and only in the designated smoking areas. A penalty of € 150 will be charged immediately to the Guest in case of incompliance.
6.4 The Customer will be responsible for any loss or damage caused at the accommodation by Guests or visitor of the Guest. The Guest may be liable for Casa do Alto’s reasonable cost of repairing, cleaning or replacing any property of Casa do Alto which is damaged, soiled or lost by a Guest.
6.6 Casa do Alto does not accept bookings made by those under the age of 18. Under 18’s must accompanied by an adult over 18 years. Children under the age of 12 cannot stay alone in a room but must share a room with their legal parent/guardian or an adult given consent by legal parent/guardian. All children until 48 months may stay free of charge in their parent’s room, but cribs cannot be provided.
6.8 You’ll be given a key when you check-in which gives you access your room. If you lose your key, it’s € 8 for a replacement.

  1. FOOD AND DRINK

7.1 Unless otherwise agreed by Casa do Alto, the Charges do not include any food or drink.
7.2 Customers and their Guests may consume food and drink purchased from Casa do Alto in the restaurant. terrace and pool area. No externally purchased food and drink may be consumed inside Casa do Alto’s restaurant. All food and drink purchased externally have to be disposed of properly by the Guest.

  1. PETS

8.1 Casa do Alto is a pet friendly accommodation. Customer must request their pet(s) addition minimum 24 hours prior to 15:00 hours (local time) on the Arrival Date.
8.2 Additional charges of € 10 per night per pet will be added to the Booking and are subject clause 4. For a comfortable stay for Guests and Pets, a maximum of 2 pets is allowed per room. Guests are responsible for providing in-room amenities for their pet, including pet bed, water/feeding bowls. Extra cleaning fee of € 25 may be charged if Casa do Alto’s beds is slept in by pet.
8.3 Pets must be fully trained and always appropriately restrained by guest. Guests can be accompanied by their pet in all areas of the accommodation and must never cause disturbance to other Guests. Casa do Alto reserve the right to require immediate removal of any pet that displays dangerous or unacceptable behavior, such as biting or excessive barking to staff or other guests.
8.4 Guests are responsible for cleaning up after their pet on Casa do Alto’s property and in the neighborhood and disposing of the waste in outside waste containers.
8.5 Pets must not be left alone on the Guests room, with the exception for short time, max 30 min, if Guest is still onsite. Guest must provide reception with phone number and be always reachable.
8.6 Daily cleaning by housekeeping is mandatory during entire stay.
8.7 Guest is liable for any damage to Guest rooms and common areas and will be charged to Guest account immediately or at check out.

  1. DISABLED GUESTS

9.1 Casa do Alto complies with all laws regulating the treatment of, and provision for, disabled Guests.
9.2 Due to the layout of the accommodation and outside property, Casa do Alto discourages guests with mobility issues from Booking at Casa do Alto. The accommodation does not have Guest rooms designed for mobility disabled guests.

  1. CASA DO ALTO’S LIABILITY

10.1 Nothing in these Conditions purports to limit or exclude the Casa do Alto’s liability for:
(a) death or personal injury caused by the negligence of Casa do Alto, its employees, subcontractors or agents;
(b) fraud or fraudulent misrepresentation; or
(c) any other matter for which it would be illegal for the accommodation to limit or exclude its liability.
10.2 If Casa do Alto breaches these Conditions or is negligent, it is responsible for the loss of damage suffered by the Customer that is a foreseeable result of the breach of negligence but are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Casa do Alto’s breach of these Conditions or if they were contemplated by Casa do Alto and the Customer when they entered into the Contract.
10.3 The Customer agrees that Casa do Alto is only supplying its facilities, products and services to the Customer for private use and have no liability to the Customer for any loss of profit, loss of business, business interruption or loss of business opportunity.

  1. PERSONAL DATA

11.1 Casa do Alto treatment of Customers data follows the General Date Protection Regulations (GDPR)  2018/1725
11.2 The Customer hereby consents to Casa do Alto collecting of the Customers personal data such as name, surname, email address, Fiscal identification nummer (NIF) , customer number, address, contact information and details of the bank account number.
11.3 The personal data is used by Casa do ALto for the performance of the Contract and for marketing and as a basis for statistics and for Casa do Alto product development.
11.4 The personal data may be analyzed and grouped for the selection, prioritization and planning of the marketing of Casa do Alto, so-called profiling.
11.5 As a customer of Casa do Alto, you agree to receive marketing information via mail, telephone, or e-mail and text messages, and other digital channels. Marketing through email and SMS is regulated in the Swedish Marketing Act. The Customer always reserves the right to withdraw from receiving marketing information.

  1. GENERAL

12.1 The Customer’s rights as a consumer under consumer protection legislation from time to time in force shall not be affected by these Conditions.
12.2 Casa do Alto may transfer its rights and obligations under the Contract to another organisation but will always inform the Customer if this happens and this will not affect the Customer’s rights under the contract.
12.3 Casa do Alto will not be liable to the Customer for any failure to perform or delaying in performing its obligations where such failure or delay is due to an event outside Casa do Alto’s control (including without limitation, extreme adverse weather, industrial action or natural disaster). If such an event prevents Casa do Alto from fulfilling the Booking, either party may cancel the Contract.
12.4 Casa do Alto may, from time to time, change these Conditions without notice. However, the version of these Conditions in force at the time of the Booking will continue to apply to the Contract. Customers are advised to check Casa do Alto’s website for the latest version of these Conditions before making a Booking.
12.5 Casa do Alto complies with its obligations under the Portuguese Law No. 58/2019 of 8th August (GDPR) in relation to personal data protection. Casa do Alto will process personal data (as defined in the Act) in relation to Customers and Guests solely for the purpose of performing its obligations and exercising its rights in connection with the Contract. Casa do Alto will not provide any such personal data to any third parties apart from third parties who provide services to Casa do Alto such as the provision of legal advice.
12.6 No failure by Casa do Alto to enforce these Conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of these Conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach and shall not constitute a continuing waiver.
12.7 If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
12.8 These Contract (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of Portugal and the court of Loulé will have jurisdiction to deal with any disputes (including in relation to non-contractual matters) arising in connection with it.
12.9 No person who is not a party to the Contract will have any rights in connection with it.
